The Meaning of Ricci

WASHINGTON -- The Supreme Court's ruling on the Ricci case -- that white firemen suffered illegal discrimination when a promotional test on which they did well was thrown out because not enough blacks did well -- will have no effect on Sonia Sotomayor's nomination to the Supreme Court. While overturned on Ricci, she is protected by the four dissenting justices who upheld the side of the case she had taken as a Circuit Court judge. Sotomayor was additionally helped by Justice Ruth Bader Ginsburg's insistence on reading her dissent from the bench, as if to emphasize the legitimacy of her position -- and, by implication, Sotomayor's.

Ricci left Sotomayor relatively unscathed. But not affirmative action. Ricci raised the bar considerably on overt discrimination against one racial group simply to undo the unintentionally racially skewed results of otherwise fair and objective employment procedures (in this case, examinations).

It's not enough for a city to say, as did New Haven, that it was afraid of being sued by black firefighters. The evidence was irrefutable that the tests were put together in a conscientious, race-neutral way. Not only were minority firefighters over-sampled in devising the questions. The designers established nine oral exam boards, each a three-person panel, each consisting of precisely one white, one black and one Hispanic. (Such is the extreme race consciousness that the Civil Rights Act, of all things, has brought upon us.) Nor will it do, as New Haven tried, to throw out a test on the pretext that another test with less racial impact might theoretically exist out there in the ether.

The defenders of the old racial order, led by Ginsburg, objected sternly, declaring that the white firemen "had no vested right to promotion." Of course they didn't, but they did have a vested right to fairness, to not being denied promotion because of their skin color.

Of course no one has a vested right to promotion. Isn't that why they gave those tests in the first place? Isn't that why for the last, oh, 125 years we have been using objective civil service exams to allocate government jobs not on the basis of right -- or patronage or favoritism or racially discriminatory advantage -- but on the basis of merit and job-related skill?

It's the Ginsburg dissent that, in effect, grants a vested right to promotion -- to African-Americans, simply because of their race -- and makes the frustration of that specious right the basis for denying promotion to white (and Hispanic) firefighters who had objectively qualified for promotion.

The major conundrum of the civil rights age remains. The 14th Amendment bans discrimination on the basis of race. But the Civil Rights Act, which bans "disparate impact" discrimination -- procedures (like exams) that yield racially unbalanced results -- affirmatively mandates racial favoritism to undo those results. The evil day will come, writes Justice Antonin Scalia in his concurrence, when this contradiction will have to be resolved.

He is right. For decades we have been finessing the issue with a mess of compromises, euphemisms, incoherences and pretenses such as banning racial quotas but promoting racial "goals." Anyone who has ever had to make hiring or admission decisions knows that this angel-on-the-head-of-pin distinction is 95 percent a matter of appearances, gestures and lawsuit-avoiding paperwork.

And yet we have muddled our way through, permitting a large dose of intentional discrimination to ameliorate past discrimination -- and present inadvertent imbalances -- without totally abandoning the ideal of colorblindness.

The result? At the near half-century mark of the Civil Rights Act, racial minorities have seen remarkable social advancement. The younger generation is infinitely more racially tolerant and accepting. We've made great racial progress. But the fundamental unfairness that underlies the racial spoils system continues to rankle. That's what animated the Ricci case.

We're 45 years beyond passage of the Civil Rights Act. We have a black attorney general and a black president. As with every passing year we move generationally away from the era of Jim Crow, it becomes less and less justified for the government to mandate "remedial" racial discrimination. Which is why in one of her last opinions, Justice Sandra Day O'Connor said that "the Court expects that 25 years from now, the use of racial preferences will no longer be necessary."

The import of Ricci, which raised the bar on reverse discrimination, is that it heads us once again toward that day -- and back to true colorblindness that was the original vision, and everlasting glory, of the civil rights movement.

The 45 year social engineering project needs to be declared 'good enough' and forced into retirement like every other civil servant that has served that long.

The import of Ricci
A little too optimistic, Krauthammer. Wasn't the Bakke decision lauded as raising the bar on reverse discrimination? 'Diversity' was the way around that.
The founding documents no where mention race. Ginsburg and any who so much as use the word should be impeached.

Heres what we do know.

Most everyone supports equality at the workplace, school, and public.

Only Liberals support quotas.

Quotas
Quotas are the embodiment of discrimination. Since the passage of the Civil Rights Act, quotas, totally unrelated to skill, ability, or talent, have been part and parcel of the Act and its interpretation by the courts. Congeess, with the help of our votes, have furthered the cause of quotas for too long a time. Diversity, the fraud being perpetrated upon the American public, continues to carry weight in the courts and again in Congress. The worst form of discrimination is to treat everyone alike. We are all different with different skills, ability, and talent. We should be treated on "the content of our character" not the color of our skin. The Recci case is one small step for Recci, one giant leap for America. Reverse racial discrimination is no different than the effects of Jim Crow. It holds down hard working people who strive to get ahead in their lives and fulfill the American Dream. It's high time to send quotas in hiring and promotion to the dust bin of history. We can only hope that Sotomayor and the other future Supreme Court nominees understand this.

Sotomayor Was Reprimanded By Carbanes
Jose Carbanes, the Puerto Rican judge who gave Sotomayor her first job before she left college, reprimanded Sotomayor for not even looking at the Constitutionality of the case.

AND those four other judges weren't nominated for the highest court of the land...it doesn't matter what they do.

THIS is what was revealed and what truly matters in the Ricci case yet, we don't need more than what we already have.

Sotomayor is not even close to being worthy of the position as it demands objectivity, not empathy, and this she has rejected as impossible for herself to do through her own writings....if her membership in a group committed to racism weren't more than enough all by itself.

Thomas is right
Send Affirmative Action to the graveyard. I wanted to do that 20 years ago because as I was working my a$$ off, my black co-worker slept in the ladies' room every afternoon and NOTHING could be done about it because she was black. This is a messed up country right now, and affirmative action or no affirmative action, we've got to get hold our ourselves and get back to equal rights for all and no special favors that end up making people lazy and empowered when they shouldn't be. And even though Sotomayer will get on the court--it's still not right! She IS a racist.

Rejection of American Excellence?
From Reverend Wright telling his congregation to not aspire to middle class or higher and Clarence Thomas being called an "Uncle Tom" for accepting and integrating into the American culture, it is no wonder that minorities believe standards need to be lowered for them. If we would just follow Rev. Martin Luther King Jr. who wanted to be judged by the content of one's character we wouldn't be talking about quotas and "affirmative action." Until people of all our diverse cultures once again pride themselves as being part of the melting pot instead of segregated cultures, it will be "us" versus "them". American excellence is based on aspiring to be the best you can be, to be the most knowledgeable, the most skillful, the most determined. We wouldn't allow for affirmative action in the Olympic games and we should allow for it in our schools, business, military or anything else. According to studies our economy is hurt by implementing social programs that don't take into account a persons IQ in hiring programs. IQ is distributed throughout the population and is a color blind measure of a person's likelihood of success on the job. It was used successfully until 1971 according to the book "The Bell Curve Intelligence and Class Structure in American Life". By not using IQ as a predictor of success our economy is losing millions in productivity. Perhaps this court case will let us go back to using this important measure of job success.

Time to Move On
Charles thanks once more for your enlightenment on this issue.

I would like to think racism is behind us but the corpse remains on life supports by the minority leadership and activist in order for them to remain relevant. Also many liberals need this cause for control.

I wish Dr. King were still alive to give us his wisdom. I think he would say its time to move on.

The Ricci Decision
Of course, Krauthammer's right, as was Michael Barone in his column.There's a certain amount of liberal political hackism surrounding this entire issue of affirmative action. And why it is that supposed legal scholars can't land on the same starting point where an obvious principal is involved, i.e., race based promotions are illegal, is beyond me.

Reverse discrimination for firefighters
is bad enough. Now think about teachers, physicians, nurses and so forth. if they start putting quotas on these groups, are a** is grass.

Come to think of it, Obama's record of "achievements" was under scrutiny during the election. As well it should be 'cause I get the impression that he doesn't know what he's doing or saying half the time. He's just eloquent with telling lies.

I think the worse thing we can do is to pass individuals on to higher positions on the basis of their color. Our present situation represents that quite well.

O'Connor's magic ball
Isn't everyone glad that O'Connor as a Supreme Court justice could look into the future and tell us how many years we would have to violate the Constitution's equal protection clause? As if a finite date of unconstitutional behavior made it okay. If her statement is not a de facto proof of judicial activism, then I don't know what is.

I disagree the Ricci will
not have a negative impact on the SCOTUS vote. The 5:4 vote serves to highlight the fact that high court decisions are driven by political ideologically. In this case, the glaring absurdity of Sotomayor's decision is punctuated by the desperate actions of Ginsburg.

The American public has an innate sense of fairness that will not readily accept a thumb on the scale of justice. The only question is how vigorously this battle will be fought.

How Is Racial Segregation
a 'good' thing?

Why is anyone taking a test 'required'
to put their race?

Surely, only so they can be discriminated
against with regards to said test if

The very act of requiring race to be
stated is automatically segregating before
the test is tallied.

So, one must surmise that segregation and
discrimination are 'good' under current

Concur in Part, Dissent in Part
Sotomayor actually did not "rule" on anything at the appellate stage. There was no opinion by the court except to pass on the issues presented and affirm the lower court decision without analyzing anything. That was why she was reprimanded by Judge Jose Cabranes. She has a history of being overturned by the SCOTUS. I think she knew she was being considered for higher office and wanted to stay away from any controversial issues in order to secure her advancement. However, according to the U.S. Constitution, Article II, Section. 2., it is the job of a S.C. justice to decide "cases and controversies". It does show a profound lack of understanding on her part towards important constitutional issues and illustrates why she isn't qualified either in brain power or temperment to sit on the Court. She certainly isn't the equal of Scalia, Roberts and Alito.

I disagree that Ginsburg was showing support for Sotomayor. Ginsburg's history includes long association with the ACLU. I believe her reading of the dissent from the bench was more an expression of extreme disagreement with the majority opinion, than a showing of political support for a judicial candidate.

There is a conflict between 14th amendment principles of equal protection and the Civil Rights Act which turns the 14th amendment on its head and establishes race-based preferences. It's absolutely the wrong approach. Ricci was decided on extremely narrow grounds - it wasn't a sweeping or broad decision. It does lay the groundwork for a later review of CRA. I agree with Roberts - the only way to stop discriminating based on race, is to stop discriminating based on race - any race.

However if you pass the tests and requirements, then you earn the privilege of promotion. Ricci earned it and then was denied, because no Black passed the test. Ridiculous. The Black people should study and work harder. Period. Ricci is dyslexic. A Black non-dyslexic can pass too by working hard.

At Trend?
The Supreme Court decision, when coupled with AG Erik Holder's shocking comment that the "hate crimes" legislation did not apply to whites or the military!!!!! Where's the equal protection?!?!?! Surely does seem like a trend under this Administration, to get even with white people for real and imagined sins of the past. It's an outrage! We HAVE made enormous progress in providing equal opportunity. I'm done with apologizing or feeling guilty about being white! My ancesters never owned slaves! Of all the people who were criminally taken from Africa, most were sold as chattel to buyers in the milddle east and South America. 3% actually came to the US! It was a horrible time in history. Enslaving any people was and remains a sin... whether it was Africans.. Russians shipped off to Siberian labor camps... Indians enslaved by new world conquerers... Romans enslaving conquered populations. This practice should have never happened, but it DID!

Half of the black community in the United States today is NOT decended from slaves, but immigrants who came here of their own free will, long AFTER slavery was abolished in the United States.

I've always supported equal opportunity.... aside from random discrimination, equal opportunity exists under the law. "Hate criimes" legislation is a political straw man! How is it any more heinous to murder a black man because he is black, or that his life is taken by a thief?!?! Both crimes should carry the same severe or ultimate penalty. What's the difference if a black carjacker kills a white woman, if he hates whites or not?

Discrimination is discrimination... racism is racism. The law should NOT be unequally applied!

Not tolerant - skin color agnostic

The Sad Truth About Diversity
Human nature, being what it is, drives people to seek out other people that are like them. This is not good or bad, right or wrong - it just is.

The result of this continued focus on diversity is to highlight what makes us different - the 5% - rather than the 95% we have in common.

This supports the political class and their primary goal of keeping people divided while laughing all the way to the bank.

Imagine a country where the concerted efforts of Americans was focused on excellence rather than some definition of 'fairness'.

It's Time to Close "Escape Hatch 'A'"
This perception of examinations being racially biased is an old dead mantra held over from the 70's. It was a great excuse "then" for failure and somewhat acceptable. After all, how could Whites relate to the "Black Experience" and the culture of the community? How could Blacks be held accountable for information and knowledge that wasn't a part of "their" environment?

One can make the case for it that is rooted in a, being polite, failed Public School system. In doesn't encourage a wide enough range of study for the collection of Blacks, especially in the "low- socio-economic regions" (coined by a Jr High School teacher during a district rezoning). Here in 2009, that arguement holds no water (didn't "really" hold much then) and there has to be a point where that reasoning has to stop. The "help" and consideration of the Inner City condition (boy am "I" being P.C.) has proven over the last 30 years to have been a hindrance. In general, Blacks are worst off with all of the "programs" with the presumed intent to offer a "leg up" have not worked,especially Affirmative Action. All of the efforts have proved to be more enabling.

As Black man, I've had a front row seat for all of this,and as I have told friends (who some ceased to "be" my friend), until we take responsibility for our existance, we will always need these "Escape Hatch 'A's'" to explain away our lack of growth with the nation.

Listen up!! Take the test. When test is completed collect them. Mark them and post the scores according to the answers that were given. Period.

What we have reaped from that is diversity as an end in itself (a headline today about the new Annapolis class speaks for itself-I hope all those divesity graduates can protect our country)

it's not every day you see five conservative justices — the sort beholden to an ideology that rails against “judicial activists” — morph into Exhibit A. For all the angst about whether Supreme Court nominee Sonia Sotomayor would make law from the bench, that's exactly what John Roberts, Anthony Kennedy, Clarence Thomas, Antonin Scalia and Samuel Alito did here.
By contrast, when Sotomayor and two other judges on the 2nd U.S. Circuit Court of Appeals upheld a lower court ruling last year supporting New Haven, they were following both the law and legal precedent — specifically, Title VII of the 1964 Civil Rights Act barring racial discrimination in employment, and a 1971 Supreme Court decision that an employer can be liable for discrimination if an employment practice (i.e., a promotion exam) has a “disparate impact” on minorities. That's the lawsuit the city attorneys in New Haven feared was coming their way given that the exam had a disparate impact on black firefighters, who had a much lower pass rate than their white counterparts.
Not good enough, said the justices. Writing for the majority, Kennedy called scuttling the exam “impermissible under Title VII unless the employer can demonstrate a strong basis in evidence that, had it not taken the action, it would have been liable” under the law dealing with “disparate impact.” The city did not present such evidence, Kennedy said.
With that, the justices brushed aside more than 35 years of legal precedent about disparate impact in racial discrimination cases and, as several critics noted, made new law — a job best left to Congress. They also probably confused the heck out of New Haven city officials, who catch flak no matter what they do.

Wouldn't it be a great idea if the exams were administered blindly, scored blindly, and promotions awarded blindly? If we assume only qualified candidates are able to take the exams, that is, there are no factors that would stand in the way of promotion should the candidate pass the exam, then why is race even a part of this transaction? MLK, Jr. said it best, and this is NOT what he had in mind.

Your analysis of the law is based on your personal interpretation of the law and cites no precedent or sources. It's just you going to Wikipedia, reading the text and deciding what you think it says. The Justices you demean in your vapid analysis are not wrong because they don't know the law, but because they don't know YOUR law.

I do sometimes enjoy your point of view, but your way way way above your pay grade on this one. Just because constitutional law is expressed in English does not mean a command of English makes you a legal scholar.

Since the 70's
Organizations, especially police depts. have complained about having to hire at least 70% black or they would not get their federal monies. This AA policy is extortionist quota hiring to say the least and most likely it is the federal govt illegally using taxpayer money to force reparations on the public at large. The end result has been many positions have over the last few decades been filled with unqualified and sometimes even criminal or felonious persons a stupid and dangerous practice. As always the federal level is just throwing away good hard earned money thru they’re of use idiot legislation and the IRS to force from the citizens. The most notorious and scandalous example of AA hiring to date is the current office of the totus, the most incompetent, unqualified and not even American to ever hold that title and true to form he is destroying the country with little or no resistance.

Desperate Impact
Affirmative action reached its expiration date years ago. The fact we're still seeking justice for minorities or the disenfranchised at any level today is(always has been), demeaning, anti-productive, destructive and divisive despite its intended purpose .
Today; This lingering, antiquated policy favors and perpetuates those who seek a further divide amongst all peoples and a continuing embrace of faux inequity.
For all the good this policy may have done back in its heyday; its worthless and regressive now.
Also, one could make a case for ever instituting this policy initially. A truly negative example(s)/ end result(s)are currently residing in the WH.

The decision was close, but demonstrates that we still have some sanity and common sense in the Supreme Court. What else would you expect fro Ginsburg? Sotomayor will be an accident waiting to happen, and any case involving Hispanics will be judged by a wise Latino women. Please pass the vomit bag.

A Win for BLACKS
Yes, this ruling is a win for blacks, no thanks to Sotominor. Blacks can now not have the stigma of Affirmative Action, at least with the fire department. Losing Our Way
Diversity ( for the sake of diversity and nothing else) is perversity. I am sorry that I am not as eloquent or articulate as the rest of my TH bretheren but this just stinks to high heaven. I have heard many pundits say that all the strikes against this affirmative action justice will not matter one iota to her confirmation. That in and of itself is appalling! I am only 43 years old but this country , as it exists today , is nothing like I remember from when I was in Little League. We are toast! Everything is just a game and power grab to these people that we stupidly elect. Are we done because of Sotomayor's impending confirmation?..No ...not particularly, she is just another cog in the mechanism of America's destruction.I am a naturally born citizen of my country. Oddly enough most of my friends are non- english speaking people from Central and South America....long story. Having known them for years I can attest to the fact that this woman does not speak for them nor for womankind. She is but an aberration. Who the F@#* cares if Ruth Bader Ginsburgh supports her position? Or what that malignant narcissistic fool of a community organizer thinks. The democrats will confirm her ,the republicans without cajones or conscience will acquiesce , because that's all they know how to do,and we are screwed. A Full Circle...
There will always be negative people who will try and turn any matter to their own advantage...playing the race card or whatever..very possible where I live where the NAACP is ready and waiting to assist. This ruling was important in balancing these issues. My father who's parents were from Eastern Europe and who never got involved in "Slavic rights" or anything remotely near any of that...once told me..that if these (discrimination) problems were something that confronted you then it was your responsibility to(go inside) and figure out where the problem was within yourself..personal responsibility.(blaming not being acceptable)..which I'm realizing he was naturally all about and had always been...and left as one of his legacies. Reality
Present conditions mean that conservatives must temporarily suspend their adherence to the rule of law and wage a different war against the left. This is normal in a time of war when a society finds itself under attack and realizes it must use all weapons at its disposal to survive.

We cheer victories in the Supreme Court because we naively belief its decisions are the final answers to questions of the constitution. This is wrong. Until an enemy is annihilated, the fight continues.

There are no white flags from the left. Listen to what they say. Last year when the Court decisively and conclusively reiterated what our founders plainly wrote, the left dismissed the decision as “narrow” and as “raising more questions than answers”, that it was a radical departure from legal precedence and therefore perhaps a decision which might be disregarded until a “more correct” reinterpretation can be rendered in a “better court”.

Washington D.C. enacted a more restrictive hand gun ban after their loss in the court.

This employment rights case is also illustrative. This case too is described as “narrow”. Obama dismisses it and announced that even more vigorous discrimination of whites is in the works, that more redistribution of fortunes will be coming.

The day is coming when conservatives will have to risk their comfortable conditions, their beer and brats, Spencer and Heidi, Octomom, American Idol and Susan Boyle, and take matters into the streets, perhaps with weapons, to protect their freedoms.

Or they can continue to exist under the laws written by their enemies.

Is the Right Wrong on Sotomayor?
If Conservatives have a problem with one or two of Sonia Sotomayor’s comments on how being a Latina woman affect her views on the world or the fact that a relative few of her decisions have been reversed in front of the high court, perhaps they ought to seek Justice Samuel Alto’s resignation at the same time. During his confirmation hearings before the Senate Judiciary Committee he made several statements as to how being the son of Italian immigrants affected his worldview. Here is just one of many: “When I get a case about discrimination, I have to think about people in my own family who suffered discrimination because of their ethnic background or because of religion or because of gender. And I do take that into account.” Regarding Alito, like Sotomayor, he too had cases that he had voted in favor of, overturned upon review by the Supreme Court.

While the Right continues to bellow about Sotomayor’s supposed bent on being likely to side with those who claim to have been discriminated against, the SCOTUS Blog has provided statistics that would lead one to believe otherwise. In 96 cases that came before her regarding discrimination she ruled in favor of the defendants just 10 times, ruling that discrimination was not operative in 78 cases with the remaining 8 cases not being substantially affected by discriminatory motives.

Barack Obama has skillfully painted the G.O.P. into a corner on this one knowing full well that the party needs to expand its appeal among minorities if it is ever to hope to become politically competitive in the long run. It is insightful that there has been little in the way of heated opposition to Sotomayor’s nomination from Republicans on Capitol Hill with most of the noise emanating from the hard right talk shows and columnists rather than from those who actually have to stand for election.

The very passage of time itself has completely delegitimized the central argument made by Justice Ginsburg.

In addition to her risible claim that the evidence in this particular case does not really support the obvious -- that blatantly racial as well as political motivation lay at the heart of the CBS decision to reject the tests -- she also angrily insisted on positing the "central role" of fireman and firefighters in perpetuating racial discord in our nation.

Wrote she:

"Firefighting is a profession in which the legacy of racial discrimination casts an especially long shadow. In extending Title VII to state and local government employers in 1972, Congress took note of a U. S. Commission on Civil Rights (USCCR) report finding racial discrimination in municipal employment even "more pervasive than in the private sector." H. R. Rep. No. 92– 238, p. 17 (1971)."

So, a nearly 40 year old dusty report is the foundation stone of her "historical" argument -- i.e., that fire departments are notoriously racist in their hiring practices . . . and that that somehow justifies intentional racial discrimination against officer candidates who had absolutely nothing to do with it?

The Irrelevancy Is Manifest!
Then too, note that the very report she cited, and a follow-up congressional report from 1972 cited such irrelevant practices (to this case), such as:

"In making hiring and promotion decisions, public employers often ‘rel[ied] on criteria unrelated to job performance,’ including nepotism or political patronage. 118 Cong. Rec. 1817 (1972). Such flawed selection methods served to entrench preexisting racial hierarchies."

Clearly, none of those practices played any role whatsoever in this case. And not one stitch of evidence suggested that any of the candidates for any of the officer positions here were any part of an entrenched racial hierarchy. A very broad group of candidates took these written and oral examinations.

So what in the heck is Justice Ginsburg talking about?

Or, for that matter, what is with any of the three other justices she somehow persuaded to hike down the irrelevancy trail with her?

There were several aspects to Judge Sotomeyor's questionable dealings in the Ricci case that should really raise eyebrows. First and foremost, there was the blatant attempt to bury the case with a summary order by the Sotomeyor panel.

It was only when Judge Cabranes caught wind of what the Sotomeyor three-judge panel had done, and sought a poll of the entire Second Circuit in banc, that the three-judge panel pulled a blatant power play four months after their initial order, resurrected the summary order, converted it "word-for-word" into a per curiam opinion, and thereby made the previously unpublished order the statement of the law for the entire circuit on an issue of first impression!

It took a pointed Supreme Court decision to straighten out a case of blatant and intentional racial discrimination against the firefighters, where even the dissenters did not agree with the Sotomeyor manner of disposition of the case! She was wrong all around.

The media would be full of stories about how black firefighters had outdone those redneck white firefighters. Anyone who questioned it would be called a racest. Obama Dismisses the Case
As for Obama, his personal response to the Supreme Court decision is absolutely pathetic.

He told the AP that, according to their article, "he's never believed that affirmative action is as much of an issue as it's been made out to be," adding that it has not been as, quoting him, "potent a force for racial progress" as some think, while also downplaying critics. He dismissed this one as a "narrow case."

Strange words from a man whose job it is to be mindful and protective of the rights of all Americans. You’d think it would matter to him when people are intentionally discriminated against, as was the case with these firefighters. But apparently because his Supreme Court nominee was quite properly "spanked" for her questionable judgment and role in the case, it is suddenly a big nothing!

But two weeks ago, he was going on and on about how his administration will be making a special effort to protect the "rights" of "7 million" Muslim Americans -- even though the best estimates are that there are well less than half that number! I wonder why the rights of imaginary people are so much more important to him that the equal rights of those in this case who we know were intentionally discriminated against?

If you really believed in merit, you would be cheering this decision. The test was devised to be non-racist. Both parties, the firefighters and the city agreed to use the test. You have to break two laws regarding contracts in order to throw out the results of the test. On the other hand, there is no law saying that disparate racial results are illegal, but only a 38 year old SCOTUS decision. Furthermore, not one of the nine justices considered that decision to be proper. It is now null and void.

Are you seriously arguing that the test was racist? On what grounds?

Wrong on all counts. The Sotomeyor three-judge panel first tried to bury the case with a summary order, by upholding a district court case that had intentionally discriminated against the firefighters in violation of Title VII. They were ignoring the law -- not "following" it!

When Judge Cabranes began asking questions, the three then "converted" their initial order into a one paragraph per curiam opinion, raising the case to the level of the statement of the law for the entire 2d Circuit -- without giving any consideration to what Judge Cabranes pointed out correctly -- that it was a case of first impression for the Circuit! Why? Because they liked the "result" even though the holding intentionally discriminated against the firefighters.

She and the other two judges had an obligation to examine the legal questions and resolve the case in controversy . . . that is their job! Instead, they ignored their obligation and voted for a result they preferred.

Of course Alito is affected by being an Italian. Just like Ginzburg is affected by being a Jew, Thomas a black, and Souter an arrogant horse's backside and mama's boy. No reason to resign. What happens is when their view takes precedence over the Constitution, which is what Sotomayor demonstrated in this case; remember, she initially dismissed Ricci out of hand and it took another liberal Democrat appointed by Bill Clinton to reverse that. That demonstrates a world-view that she has said she approves of, which is that a "wise Latina woman" receive preference over highest test scores and other demonstrations of achievement. She is the poster child for a Hispanic quota, so she intends to assure that the quotas live long.

What Congress should do is insist that the next justice level the racial mix playing field. We need another black, a woman, and because the nation is mostly conservative, the person should also be conservative. I recommend Starr Parker or Ann Coulter in blackface.

I was once a VP with a fortune 100 company. I had several departments and over 600 employees.
Our facility was in a large urban area with significant Black, Hispanic and Native American populations.

I will simply say that every hiring decision had to be considered against a plethora of Civil Rights related rules, laws, quotas et al.

Any misstep could be a "career limiting" error. It was a frigging mine field by any stretch.

Diversity is an oximoron
The very word diversity means division, so how can that translate into a united strength for the United States of America.

The "oversensitivity" of diversity places executives in the private sector in a no-win situation when dealing with minorities.

Speaking from experience, I was accused by a black from Ethiopia who was a member of my department, of racial discrimination. The individual was a better than average worker, received raises above the average for his peers, and still felt he was discrimintated against because he did not get a promotion for which he was not yet quailifed, in both experience and ability. I was a senior vice president with ownership in a minority-owned consulting firm and managed a group of about 45 professionals, over half of whom were either minorities or women or both. Every other person who worked was stunned by the charge because, besides being false, they knew that was the last thing I would ever do. The charge was outrageous (it was finally thrown out by an EEOP mediator), but it damaged my reputation with the majority partner, eventually leading to my dismissal for "unspecified" reasons (and a year's salary to go away quietly). This came after a record year in both revenue and profits for my group.

The ability to cry racism is encouraged by liberals who don't have a clue about what it takes to succeed in private industry. Quotas, lies, and settling for the lowest common denominator will be one of the cornerstones of the downfall of this great nation. The last thing we need is another Supreme Court justice who will prolong this abomination of the constitution. But, electing a socialist liberal like Barry-O was a guarantee that we'll see a constant stream of changes that threaten the very existance of this country. Just another brick in the wall.

Having grown up in the 50s and 60s having lived in the north and the south I have seen racism against the black population and it was horrendous. We have made great strides in this but it does still exist and is promoted not by the white people but by the black leaders. If you live in a big city the black drop out rate in high school is horribly high. Our school system is a failure and we keep throwing more money at it. Our children should not be allowed to quit school, the drug dealers should be shot on the spot. The teachers should be given a paddle and it should be used. The teachers are now afraid of the students. When they graduate from high school they should either have to join the military or go to a trade school or college. Give them the education they deserve and they will be hard working upstanding citizens. Let them run the streets and they will be criminals. I have more black and hispanic friends then I do white friends and I am white. I dont care for Unions but the employer should have to have a legitimate reason to fire someone and they should have to put it in writing. If a person is doing his job he should not be fired because someone doesnt like them or agree with them.God Bless the U.S.A. and return it to the people.

Here is the embarrassing/chagrining part about the test---> the City of New Haven had hired a consulting firm to design a test that the minorities could pass! BUT THEY ALL FAILED IT!

For some who opine that a written test for Fire Marshalls/Chiefs might not be telling, actually it is-- they are managers and must use judgment, knowledge and communications skills to save lives, which otherwise are more at risk.

affirmative action hurts minorities
the constant drumbeat of racial equality and quotas hurt the very people that they are meant to help. When you see minorities in leadership and managerial positions there is always that question.

Did they make it on merit or by the color of their skin?

Any minority that worked hard and got to where they are the old fashioned way are hurt. You are always looked at as the token minority until you reprove yourself.

Reverse Discrimination
When you get right down to it, there is no such thing as "Reverse Discrimination." You either discriminate or you don't. You are either racist or you're not. It is obvious that Sotomayor is a racist and that her decision in the Ricci case was discriminatory. Her own statements that a Latina woman will more often than not make better decisions than a white male is both racist and discriminatory. It won't have any effect on her becoming a Supreme Court Justice because the Liberals running Congress right now feel the same way she does.

We have gone way past the Civil Rights Act and are now at a place where we coin words to suit our progressive agenda that we can somehow atone wrongs from the past by enforcing some new wrong as a counter measure. Selecting people for any position based on skin color is discriminatory regardless of which skin color you prefer at the time. It's not "Reverse Discrimination" it's just today's brand of "Discrimination." Pretending it's something else and hiding it behind some false, noble banner is pure BS.

Qualifying for ICU
Basically was based on past experience, history and ability to learn strategic necessities quickly. Every new RN was assigned a mentor for at least 3 months who continued to work on skills that had been taught in the entry classes. We were color and origin blind but we we could not ignore stupidity. I was an educator there for 4 years and there were several new RN's that were "let go" during that time.

The worst situation we (I had a partner) ever experienced was an RN from the general floor who could not, after 6 months, grasp the essentials. She finally took it upon herself to quit as her daughter was getting married and she needed time for that occasion. Thank God.

I can just see what would have happened if we had been told we HAD to hire her. The hospital would have been slammed with a lawsuit because she would have, eventually, caused a death.

That's Ok
If we give Sotomayor more shots at racism and discrimination, we'll see more of her poor logic and complete lack of concern for blind justice in the years to come.

"Reverse" Discrimination
is a bad term because it implies that whites are the ones who generally discriminate, which is a bigoted notion. How about we simply call it "discrimination"?

I just wanted to let everyone know that there WERE black firemen that passed the promotion test. They were not at the top of the list, but they would have been promoted within two years (the life of the list). Those firemen (they were all male) chose not to join the lawsuit to show solidarity to the other blacks that failed the test....

"I'm encouraging Americans to send these postcards in plenty of time for Barack Obama's birthday," said Joseph Farah, editor and chief executive officer of WND and someone who has made it his personal mission to find that missing birth certificate. "This is an opportunity to anyone to send two messages at once to Obama – one concerning the search for truth about his constitutional eligibility for office and the second your own personalized note."

Farah points out the postcards can be used to send notes to anyone – not just Barack Obama.

"These postcards are not pre-addressed to the White House," he said. "They are postcards that can be used to send to your friends, your member of Congress, your relatives. It's just another way of keeping the issue of eligibility on the front burner – right up through 2012 if necessary."

Purchasers of the postcards will receive mailing addresses for the White House and Congress should they choose to use them for those purposes.

It's just the latest effort by Farah to raise the visibility of an issue he says was ignored by his colleagues in the media and most of the nation's elected officials, including Republicans.

Fear of lawsuits obviously a lie
If the city council says that fear of lawsuits was the cause of their decision, why didn't an actual lawsuit cause them to reverse it?

Something is amiss
If the black firemen tested best, they'd be promoted. Everyone should agree to that and have no problem with that. Right? Sotomayor and Ginsburg would have no problem either unless the promotions were denied.

We live in a world where 2 + 2 no longer equals 4.

When did Obama become black?

Last time I looked, Obama had a white mother and was raised by his white grandmother. Why is he continually described as black and not white?

I thought that after the Civil War we gave up on the concept on one drop of black blood made you black. Have we not undone the Dred Scott laws?

Perhaps Mr. Obama describes himself as "Black" because it is to his personal advantage to do so, affirmative action favors him if he is black.

So, Mr. Post Racial is really using race to promote himself, and we all go along with it!! What a joke we are for letting him get away with it, because we do not want to be labeled racists.
